Knoxville Divorce Lawyers

At The law office of Thomas M. Parker & the law office of Stanley F. LaDuke, a large percentage of our legal practices are devoted to helping people who are seeking separation and divorce. We have been doing this work for almost 20 years, and we have a thorough understanding of the law – as well as of human nature. From our shared offices in Knoxville, we will handle every aspect of your case personally, from court filings to court appearances to post-divorce modification orders, if necessary.

The laws are constantly changing, and  our attorneys are versed in the latest developments (see our web page on Child Support to learn of the latest changes in the child support laws.)

Contact us to schedule an appointment to review your case. We’ll tell you how we would handle your case and what our fee would be, and then you can decide whether to retain us to handle your divorce.

If your family law problem does not require the assistance of an attorney, we will tell you that, too. There is no need to spend money unnecessarily. We are here to be of help to you.

Types of Tennessee Divorce

There are two major categories of divorce in the state of Tennessee: No Fault (uncontested) and Fault Grounds (contested).

No Fault: In Tennessee, a no-fault divorce is called “irreconcilable differences.” If a couple has already reached an agreement between themselves about all aspects of the divorce and property division, then the case can be a no-fault Divorce, and we will simply draw up paperwork for you to sign. If there are children in the marriage, the court will require the parties to enter into a permanent parenting plan. Our attorneys will stay with you through that process.

Fault: If the parties cannot agree – if they are contesting issues related to property division, child custody, spousal support, or child visitation, then one party will have to sue for divorce based on fault grounds. If children are involved and the parties cannot agree on co-parenting issues, the court will order all parties to enter into mediation and our lawyers will stay with you during that process. Typical examples of fault grounds are cruelty, adultery, or inappropriate marital conduct.

There is no community property under Tennessee divorce law. There is separate property (which the parties owned prior to marriage or which they personally inherited during the marriage) and marital property (acquired during the marriage). Marital property is subject to equitable division.

There is a waiting period for getting an “irreconcilable differences” divorce in Tennessee: 60 days without children—or 90 days if there are children from the marriage.

Contact us to schedule an appointment to meet with a Knoxville divorce lawyer for a review of your case. We serve clients throughout eastern Tennessee, including Knoxville, Oak Ridge, Lenoir City, Loudon, Kingston, Maryville, and Clinton, and Knox, Sevier, and Roane counties.
